Service Agreement
CAN YETI™ SERVICE AGREEMENT AND WAIVER OF LIABILITY
This Service Agreement and Waiver of Liability (“Agreement”) is made and entered into between Can Yeti™ (“Service Provider”) and the undersigned (“Customer”). By signing this Agreement, the Customer acknowledges and agrees to the terms and conditions outlined below regarding the refuse and recycling can management service provided by Can Yeti™.
- Service Overview Can Yeti™ agrees to provide refuse and recycling can management, including moving cans to the curb for scheduled pick-up and returning them to their designated location after collection.
- Waiver of Liability The Customer agrees to release and hold harmless Can Yeti™, its owners, employees, and contractors from any and all liability, claims, or damages arising from the provision of services, including but not limited to property damage, missed pickups, or failure to access cans due to the conditions outlined below.
- Access to Cans
- The Customer is responsible for ensuring Can Yeti™ has full access to the refuse and recycling cans on the scheduled pick-up day.
- Can Yeti™ will not be responsible for missed service if access to the cans is blocked by locked garages, gates, or other barriers.
- In cases where snow, ice, or other weather-related conditions obstruct access to the cans, Can Yeti™ will not be liable for missed pick-ups. It is the Customer’s responsibility to ensure pathways are clear for Can Yeti™ to perform the service.
- Winter weather: Can Yeti™ will not be responsible for missed refuse or recycling can-to-curb service if roads are not properly plowed or are deemed unsafe for travel by Can Yeti™.
- Garbage and Recycling Requirements
- All refuse and recyclables must be fully contained inside the cans with the lids closed.
- Can Yeti™ will not handle or move any refuse or recyclables that are stacked against, outside, or around the cans.
- Bear Disturbance
- Can Yeti™ will not provide clean-up services if bears or other animals disturb the refuse or recycling cans unless the Customer has agreed to and purchased the optional “Bear Clean-Up Add-On” at the time of service sign-up.
- Missed Pick-Ups and Notification
- In the event that Can Yeti™ is unable to complete the service due to any of the above conditions, Can Yeti™ will notify the Customer of the missed service. Can Yeti™ will not be held liable for any missed or incomplete pick-ups due to circumstances outside of its control.
- Customer Responsibilities
- The Customer agrees to ensure that refuse and recycling is properly prepared for pick-up in accordance with the terms of this Agreement.
- The Customer agrees to notify Can Yeti™ of any changes to the property’s access or pick-up schedule.
- Indemnification The Customer agrees to indemnify and hold harmless Can Yeti™, its owners, employees, and contractors from any claims, damages, or losses, including attorney’s fees, that arise from any breach of this Agreement or failure to provide access to refuse or recycling cans.
- No Affiliation with South Tahoe Refuse
The Customer acknowledges that Can Yeti™ is an independent service provider and is not a subcontractor, agent, or affiliate of South Tahoe Refuse (STR). Can Yeti™ operates independently and has no partnership or contractual affiliation with STR. As such, Can Yeti™ does not perform services on behalf of STR and is solely responsible for the refuse and recycling can management services outlined in this Agreement.
The Customer agrees to indemnify and hold harmless South Tahoe Refuse, its owners, employees, and contractors from any and all claims, damages, or liabilities arising from the services provided by Can Yeti™.
- Agreement Term This Agreement shall remain in effect until terminated by either party in writing. Can Yeti™ reserves the right to modify the terms of this Agreement upon notice to the Customer.
Payment for service indicates that you have read, understood, and agree to the terms outlined in this Agreement.
